By renting a bin from Bin Haulin’; you are agreeing to the following terms.

 

  1. ORDERING PROCESS:

  1. Bin Haulin’ processes all bin rentals either via telephone or via our website which is located at www.binhaulin.ca.  The customer agrees that upon placement of the order and signing of the contract, then a binding and enforceable rental agreement shall exist between Bin Haulin’ and the customer. 

 

  1. RENTAL PERIOD:

  1. The rental period is 10 days which includes the drop off and pick up date.

  2. After the rental period the bin will be charged out at an additional $10.00 extra per day.

  3. A bin swap out in between initial drop off and pick up because the bin is full will be charged at an additional $200.00 per swap out. 

  4. A courtesy call will be placed on the final day of rental to make pick up arrangements.  If there is no communication the bin will automatically be picked up on the 10th day.

  5. Bin Haulin’ will make every effort to ensure timely delivery and pick up of the bin, however due to circumstances beyond our control including but not limited to inclement weather, hazardous roads or driving conditions, traffic delays, motor vehicle accidents, delays at landfills and equipment failure, we do not guarantee delivery times or dates.

 

  1. LIABILITY:

  1. Bin Haulin’ Inc. reserves the right to empty any bin on site if they contain hazardous material or contaminants.

  2. Bin Haulin’ Inc. is not responsible for any damages to the property caused by the bin or truck during delivery or pickup.

  3. Bin Haulin’ Inc. reserves the right to return any load rejected at the dump, and a service fee of $250.00 will be charged, in addition to your original rental rates.

  4. All Bin Haulin’ bins must be placed on the property for which its use is intended.

  5. All bins MUST remain in the place that they are dropped and shall not be relocated.

  6. All bins must remain free and clear of any obstructions, including but not limited to snow, vehicles and debris.

 

  1. MISCELLANEOUS:

  1. Overloaded bins will be charged an additional 25% of the regular rental rate.

  2. If the bin is unsafe to carry on the road, or the truck is not able to lift the bin onto the truck, for the safety of our drivers and others on the road, the bin will be leveled off before leaving the property.

  3. Mixtures of clean fill, brick, concrete and asphalt with waste could be subject to additional fees.

  4. Additional service charges will apply for dumping:

  • Fridges, freezers and air conditioners - $125

  • Tires - $15

  • Paint Cans - $6

  • Mattress / Boxsprings - $36 each

  • Asbestos and Hazardous Waste – will be dependent on cleanup costs.

 

  1. PAYMENT & INVOICING:

  1. A flat rate for the rented bin size plus HST will be charged to your credit card at the time of booking.

  2. Additional weight will be charged to your credit card immediately after weighing in at the transfer station if applicable.

  3. Additional charges will apply if the below conditions are not met:

    • Bin is load leveled.

    • Bin does not contain any hazardous waste or contaminants.

    • Rental period does not exceed the original request.

    • Additional service charges are not incurred.

  4. Invoices are available upon request.

  5. An invoice will automatically be provided to contractors or those exceeding the weight limit. 

  6. The customer authorizes Bin Haulin’ to process and charge their credit card for any and all amounts due in this agreement.

  7. The customer agrees to pay all collections costs, including legal fees incurred by Bin Haulin’.  Once collected, payments will be applied first to the collection costs, next to any accrued interest and last to the principle amount owing. 

 

  1. CANCELLATION/TERMINATION:

  1. A service fee of $75.00 will be charged on cancellations of bins via email with less than 24 hours notices.

  2. A truck charge will be charged of $150.00 will be charged at delivery if customer rejects the bin for any reason or the bin cannot be dropped in the specified location and a return trip is required.

  3. Bin Haulin has the right to terminate this Contract immediately upon notice to customer in the event of any breach of this contract by customer, without limiting all other rights of Bin Haulin under this contract and at law.

 

  1. INDEMNITY:

  1. The customer agrees to indemnify, defend and hold harmless Bin Haulin’, including its officers, directors, members, employees, agents, affiliates, subsidiaries, successors and assigns from and against any and all claims, counterclaims, suits, demands, actions, causes of action, damages, setoffs, liens, attachments, judgments, debts, fines, penalties, charges, expenses, costs or other liabilities of whatsoever kind or nature (collectively, “Losses”) asserted or alleged by any third-party arising from or related to:

    1. Overload expenses

    2. Customers failure to obtain and / or maintain any required permit

    3. Customers use or storage of prohibited substances

    4. Loss or theft of the bin

    5. Damage and / or destruction of the bin during the applicable rental term

    6. Personal injury and / or property damage relating to customers us and / or possession of the bin

    7. Physical damage to streets, roadways, driveways, walkways, pavement, curbs, wells, irrigation systems, septic systems and/ or underground utilities caused by the bin

    8. Customers breach of these terms and conditions

    9. Any fees, penalties, fines, assessments, charges, costs and expense asserted by a third party (including, without limitation a towing company) incurred in connection with the movement, placement and / or use of the bin.

 

  1. WAIVER; LIMITATION OF LIABILITY AND DISCLAIMER OF WARRANTIES:

  1. Except in the event of the gross negligence or intentional misconduct of Bin Haulin’, the customer hereby waives any and all claims and losses against Bin Haulin’ relating to or arising from customer’s rental of the bin and / or Bin Haulin’s performance under this contract, including, but not limited to, any damage to customer’s property, pavement, curbing, driveways, walkways, landscaping, lawn, wells, irrigation systems, septic systems and / or underground utilities related to or arising from the storage or transport of the bin in or on customer’s property, including, without limitation, any damage to customer’s property from leaks or stains relating to customer use of the rental bin.  The rental bin shall be provided on an “as-is” basis, and Bin Haulin’ makes no warranties to customer, either express or implied, including, but not limited to, warranties as to merchantability, fitness for any particular use or purpose that the bin will meet your requirements.

 

  1. GENERAL PROVISIONS

  1. Customer shall not assign this Contract without the prior written consent of Bin Haulin’.

  2. This Contract shall enure to the benefit of and be binding upon the respective heirs, executors, administrators, successors and permitted assigns of the parties hereto.

  3. Customer shall promptly do, make, execute, deliver, or cause to be done, all such further acts, documents and things as Bin Haulin’ may reasonably require for the purpose of giving effect to this Contract.

  4. This Contract constitutes the entire agreement between the Parties with respect to the subject matter.

  5. No waiver of any provision of this Contract shall constitute a waiver of any other provision, nor shall any waiver of any provision constitute a continuing waiver unless otherwise expressly provided.           

  6. Time shall be of the essence in this Contract. 

  7. Rights and obligations under this Contract which by their nature should survive will remain in effect after termination or expiration hereof.

  8. The invalidity or unenforceability of any provision of this Contract shall not affect the validity or enforceability of any other provision of this Contract, which shall remain in full force and effect.

  9. This Contract shall be governed by the laws of Ontario.
